§1

GENERAL PROVISIONS

  • These Terms and Conditions have been drawn up pursuant to Article 4 of the Act of 15 November 1984 – Transport Law (consolidated text Journal of Laws 2020, item 8).

  • The terms used in these Terms and Conditions shall be understood as follows:

a) Carrier – ABi TRANS s.c. with its registered office at 75-200 Koszalin, ul. Jasna 2a.

b) Carriage Agreement – an agreement concluded between the Carrier and the Passenger at the time of seat reservation; under this agreement, the Carrier undertakes, for a specified fee, to transport the Passenger together with luggage from the departure location to the destination.

c) Passenger – a person using the carriage service provided by the Carrier on the basis of purchased and paid tickets.

d) Carriage Service – a service of transporting passengers by a vehicle on the route reserved by the Passenger.

e) Electronic Ticket – a document entitling the Passenger to use the transport service on a specified date, at specified times, and for the agreed and paid price. The Electronic Ticket is printed by the Passenger from the online ticket sales system.

f) Means of Transport – a passenger car used by the Carrier to provide the Transport Service.

g) Online Ticket Sales System – a system enabling the Passenger to book transport on a specified date, at specified times, and for the agreed price. Printing of Electronic Tickets and payment for the purchased transport service is available at www.abitrans.pl

 

§2

RESERVATION AND TICKET PURCHASE

  • Making a seat reservation in the Online Ticket Sales System for a booked journey constitutes the conclusion of the Carriage Agreement and acceptance of these Terms and Conditions.

  • A ticket may also be reserved by phone at +48 791 06 05 05. Such an order will be confirmed by SMS and constitutes the conclusion of the Carriage Agreement and acceptance of these Terms and Conditions.

For telephone reservations, the Passenger is obliged to make payment via BLIK or bank transfer immediately after making the reservation. Telephone reservations with payment to the driver will not be accepted.

  • Persons arriving without prior reservation may pay the driver in cash or by payment card (except American Express), provided that the driver confirms that a seat is available in the vehicle.

  • White Package:

    No changes allowed to the ticket

    Cancellation with a 100% ticket price deduction

    1 large piece of luggage

    1 piece of hand luggage

    In case of flight delays, the ticket becomes invalid

  • Silver Package:

    One change allowed on the ticket up to 24h before bus departure (date/time/name)

    Free cancellation up to 24h before bus departure

    1 large piece of luggage

    1 piece of hand luggage

    In case of flight delays, the ticket is valid for the next bus journey with available seats

Price of the White Package remains unchanged.Price of the Silver Package increases by PLN 10.

Extra charges:

  • Baby stroller – PLN 5

  • Additional large luggage – PLN 5

 

§3

PASSENGER OBLIGATIONS

  • The Passenger is obliged to comply with the general rules and regulations applicable to passenger transport.

  • The Carrier has the right to refuse or remove a Passenger during the journey if the Passenger:

    • is intoxicated or under the influence of drugs;

    • does not comply with these Terms and Conditions;

    • behaves in a way that is burdensome to other passengers or may endanger safety, punctuality, or continuity of transport.

  • The threat referred to in §3(2) shall be determined at the discretion of the Driver or another person authorized by the Carrier.

  • Transporting children and their age must be reported in advance for safety reasons:

    • Children under 12 must travel only under the care of an adult.

    • Youth between 12 and 18 may travel independently with a valid ticket and a “Minor Travel Consent Form” completed by a parent or legal guardian. The form must be filled in and signed in the presence of the Driver or office staff and handed over before boarding.

    • The Carrier is not responsible for minors traveling without a legal guardian.

  • The Passenger is obliged to:

    • meet the Carrier’s travel requirements;

    • carry valid identification;

    • fasten seat belts in the vehicle;

    • follow the Driver’s instructions.

  • It is forbidden to consume alcohol, use drugs, or smoke tobacco (including electronic cigarettes) inside the vehicle.

 

§4

CHANGE OR WITHDRAWAL FROM THE AGREEMENT

  • The Passenger has the right to change the reservation date or withdraw from the journey. The conditions for changing or withdrawing from the journey are set out in §4(3) of these Terms and Conditions.

  • A change of reservation may concern the travel date as well as the luggage.

  • Conditions for changing the date or withdrawing from the journey:3.1. Full refund (less handling/bank fees) if cancellation is made more than 48 hours before the transfer.3.2. 50% refund (less handling/bank fees) if cancellation is made between 24 and 48 hours before the transfer.3.3. No refund if cancellation is made less than 24 hours before the transfer.3.4. Change of reservation date reported more than 48 hours before the transfer is subject to a fee of 20% of the ticket price. Payment must be made at the company office or via bank transfer. Failure to pay results in automatic cancellation.3.5. Change of reservation date reported between 24 and 48 hours before the transfer is subject to a fee of 30% of the ticket price. Payment must be made at the company office or via bank transfer. Failure to pay results in automatic cancellation.3.6. No changes are possible less than 24 hours before the transfer.

§5

CARRIER’S WITHDRAWAL FROM TRANSPORT

  • The Carrier may withdraw from transport if circumstances occur beyond its control, caused by force majeure (weather conditions, traffic bans, other sudden political/economic circumstances).

  • The Carrier may withdraw from transport if the Passenger does not comply with transport regulations or if the nature of the items carried makes the transport impossible using available vehicles, and the Passenger failed to report this when making the reservation (e.g., skis, bicycles, oversized musical instruments).

  • The Carrier reserves the right to change airport transfer times.

  • The Carrier reserves the right to cancel transport without providing a reason at least 24h before the planned departure. In such a case, the Passenger is entitled to a 100% refund.

  • The Carrier may withdraw from transport if the Passenger is absent at the designated transfer time and is unreachable by email/phone.

 

§6

CIVIL LIABILITY

  • The Carrier is liable for items transported by the Passenger only if the damage is caused by the Carrier’s fault.

  • The Carrier is liable for luggage as for a shipment if the Passenger places it in an area designated by the Carrier without constant supervision.

  • The Passenger is liable for any damage or contamination of the vehicle or other Carrier’s equipment caused by them or by persons under their care and must compensate for the actual cost of the damage.

 

§7

LUGGAGE

  • Each Passenger may carry two pieces of luggage free of charge: one piece of hand luggage (easily stowed) and one piece of checked luggage in the baggage compartment, not exceeding the airline’s luggage weight limits.

  • Checked luggage must be properly packed to avoid damage during transport.

  • If the luggage does not meet the requirements set out in these Terms and Conditions, the Carrier may refuse to accept it.

  • Luggage must not be placed on seats.

  • The Passenger must label their checked luggage for identification.

  • Luggage must be collected by the Passenger immediately upon arrival.

  • The Carrier is not responsible for items left in the vehicle.

 

§8

RESERVATION CONFIRMATION

  • A valid, i.e., paid reservation is the only document entitling to travel.

  • Payment to the Driver in cash or by card (except American Express) is allowed.

COMPLAINTS

Complaints must be submitted by email to reklamacje@abitrans.pl

The Carrier shall respond to complaints within 30 days of receipt.

If a complaint is incomplete, the Carrier shall request completion within 14 days, failing which the complaint will not be considered.

The Carrier is not liable for damages caused by reasons beyond its control, in particular:

  • road accidents or collisions causing delays;

  • exceptionally severe weather or other conditions;

  • compliance with police requirements;

  • road accidents or fatalities;

  • acts of vandalism or terrorism;

  • road closures, detours, traffic congestion;

  • other circumstances beyond the Carrier’s control.

 

§10

FINAL PROVISIONS

  1. Animals may only be transported in cages and must not exceed 15 kg. Guide dogs are an exception.
  2. A cleaning fee of PLN 200 may be charged for soiling the vehicle.
  3. These Terms and Conditions enter into force on 01.09.2023.
  4. The route of transport is determined by the Carrier.
  5. Any disputes arising from non-compliance with these Terms and Conditions shall be resolved by the competent court for the Carrier’s registered office.
  6. These Terms and Conditions apply to licensed transport carried out exclusively with vehicles owned by the Carrier or its partners/subcontractors.
  7. For matters not regulated by these Terms and Conditions, Polish law shall apply, followed by the Civil Code.
  8. The Carrier undertakes to protect Passenger personal data in accordance with the Personal Data Protection Act of 10 May 2018 (Journal of Laws 2018, item 1000). ABi TRANS s.c. is the data controller. The Carrier undertakes to keep data confidential and not disclose it unless authorized by the Passenger or required by law. This obligation continues after termination of the legal relationship.
  9. The Carrier guarantees strict protection of Passenger personal data and processes it only for order fulfillment or purposes for which consent has been given, in accordance with GDPR (Regulation (EU) 2016/679) and the Act of 10 May 2018 on personal data protection. Passengers may request correction or deletion of their data.
  10. Personal data is collected exclusively for marketing and statistical purposes. By accepting these Terms and Conditions, the Passenger consents to such processing. Data may only be shared as required by law. Passengers have the right to access and correct their data under the Act of 10 May 2018. Providing personal data is voluntary.
